Welcome to Amara Blue. These Terms & Conditions apply to your use of amarablue.com, including purchases from the online store, digital downloads, supporter subscriptions, personalized supporter content, and any physical merchandise offered through the website.

By using this website, creating an account, purchasing a product, or subscribing to a paid membership, you agree to these Terms & Conditions.

1. About Amara Blue

Amara Blue is an independent music and creative project offering music, digital content, supporter memberships, ebooks, images, videos, and other creative products.

2. Supporter Subscriptions

Amara Blue offers free and paid supporter membership tiers.

The primary purpose of a paid supporter subscription is to support the continued creation of Amara Blue music, videos, artwork, and other independent creative projects.

Depending on the selected tier, supporters may also receive benefits such as access to ebooks, exclusive images or videos, behind-the-scenes content, personalized supporter images, merchandise discounts, early access, or other benefits described on the subscription page.

These benefits are supporter perks. The subscription price is not intended to represent the exact retail value of the individual benefits received, and there is no guaranteed one-to-one exchange between the amount of financial support provided and the monetary value of the perks.

A supporter subscription does not create any ownership, investment, royalty, profit-sharing, employment, partnership, or other financial interest in Amara Blue, its music, brand, or creative works.

Subscriptions are not charitable donations and should not be treated as tax-deductible donations unless expressly stated otherwise.

3. Subscription Benefits

The benefits included with each membership tier are described on the subscription page at the time you subscribe.

Amara Blue may occasionally add, replace, improve, or discontinue individual membership benefits as the project develops. The exact format, frequency, design, or type of exclusive content may therefore change over time.

Where a significant change materially affects a paid membership, reasonable notice will be provided where required by applicable law.

We do not guarantee a specific number of new songs, ebooks, images, videos, releases, or other creative works within any particular month unless this is expressly stated as part of the subscription offer.

4. Subscription Billing and Automatic Renewal

Paid subscriptions are recurring subscriptions unless clearly stated otherwise at checkout.

Your chosen subscription price will be charged at the beginning of each billing period using the payment method selected during checkout.

Subscriptions automatically renew until cancelled.

For “pay what you want” subscriptions, you agree to the recurring monthly amount you select, subject to any minimum amount shown on the website.

Applicable taxes or other charges will be displayed or handled as required by law and the payment provider.

Payments may be processed by third-party payment providers. Their own payment-processing terms and privacy policies may also apply.

5. Cancelling a Subscription

You may cancel a paid subscription at any time through your member account where this option is available or by contacting Amara Blue.

Cancellation prevents future subscription renewals. Unless otherwise required by law or stated at the time of cancellation, access to paid membership benefits continues until the end of the period already paid for.

We generally do not provide partial or prorated refunds for unused portions of a subscription period, except where required by applicable consumer law.

Cancelling a subscription does not affect digital products that you purchased separately from the membership.

6. Personalized Supporter Content

Certain membership tiers may include personalized digital content, such as an Amara Blue supporter image featuring your name.

You are responsible for providing the correct name, wording, social-media profile/page link, or other information required to prepare the personalized content.

Personalized content is created in Amara Blue's visual style. Exact poses, backgrounds, clothing, composition, or other artistic elements are not guaranteed unless specifically agreed.

Requests containing illegal, abusive, discriminatory, sexually explicit, defamatory, infringing, or otherwise inappropriate material may be refused.

If you ask Amara Blue to publish your supporter image publicly or tag your social-media profile or page, you give permission for the submitted name, image, profile/page link, and related supporter recognition to be used for that purpose.

You may share your personalized supporter image on your own personal social-media accounts unless otherwise stated.

7. Digital Products

The Amara Blue store may offer digital products including:

music and album downloads, ebooks, PDFs, images, wallpapers, digital artwork, supporter content, and other downloadable materials.

Digital products are normally made available electronically after successful payment.

Unless otherwise stated, purchasing a digital product gives you a limited, non-exclusive, non-transferable license for your own personal use.

You may not resell, redistribute, upload, reproduce for commercial purposes, sublicense, share download files publicly, claim ownership of, or otherwise commercially exploit Amara Blue digital products without written permission.

Music purchased as a download is for personal listening only unless a separate commercial license has been expressly granted.

Ebooks and other written materials may not be copied, republished, sold, distributed, or uploaded to other websites or platforms.

You are encouraged to save a personal backup of purchased downloads where technically possible.

8. Digital Content and Right of Withdrawal

Nothing in these Terms removes any mandatory consumer rights that apply to you under the law of your country.

Where consumers have a statutory cooling-off or withdrawal period for online purchases, those rights will apply as required by law.

For digital content that is supplied immediately, such as downloadable music, ebooks, images, or other digital files, you may be asked to expressly consent to immediate delivery and acknowledge that your statutory right of withdrawal may end once downloading, streaming, or access to the digital content begins, to the extent permitted by applicable law.

If digital content is defective, incorrectly supplied, or cannot reasonably be accessed because of a problem on our side, please contact us so that we can attempt to correct the issue or provide another remedy required by applicable law.

9. Refunds for Digital Products

Because digital products can generally be accessed or downloaded immediately, purchases of successfully supplied digital content are normally non-refundable once access or downloading has begun, where permitted by law.

This does not limit your statutory rights relating to faulty, incorrectly described, unavailable, or improperly supplied digital content.

If you accidentally make a duplicate purchase or experience a technical issue, please contact us and we will review the situation individually.

10. Physical Merchandise

Amara Blue may offer physical merchandise in the future.

Product descriptions, prices, available sizes, shipping destinations, estimated delivery information, and applicable shipping charges will be displayed with the relevant product or during checkout.

Physical merchandise may be produced or fulfilled by third-party manufacturers or fulfillment partners.

Delivery dates are estimates unless specifically guaranteed.

Any statutory rights relating to cancellations, defective goods, returns, refunds, or replacements remain unaffected.

Personalized or made-to-order merchandise may be excluded from certain cancellation or return rights where applicable law permits.

11. Prices

Prices are displayed in the currency shown on the website.

We may change product or subscription prices from time to time.

Changes to standalone product prices apply to future purchases.

Unless otherwise stated, the music, recordings, lyrics, ebooks, written content, images, videos, graphics, logos, designs, branding, website content, and other creative material associated with Amara Blue are owned by or licensed to the website operator and are protected by applicable intellectual-property laws.

Purchasing a product or subscription does not transfer copyright or other intellectual-property rights to you.

You may not use Amara Blue's name, identity, artwork, music, images, voice, branding, or other protected material to impersonate Amara Blue, falsely suggest an endorsement or partnership, create unauthorized commercial products, or otherwise misrepresent your relationship with Amara Blue.

13. Accounts and Member Access

Some content may require a member account.

You are responsible for keeping your login information secure and for activity occurring through your account.

Membership access is intended for the individual subscriber and may not be shared, resold, transferred, or made publicly available.

We may suspend or terminate an account where there is reasonable evidence of fraud, unauthorized redistribution of content, abusive behavior, attempted misuse of the website, or a serious violation of these Terms.

Where appropriate, we will provide notice before termination unless immediate action is reasonably necessary to protect the website, other users, payment systems, or intellectual property.

14. Website and Content Availability

We aim to keep the website and member content available, but uninterrupted access cannot be guaranteed.

Temporary interruptions may occur because of maintenance, hosting problems, payment-provider issues, technical failures, third-party services, updates, or circumstances outside our reasonable control.

We may modify, redesign, replace, or discontinue parts of the website as the Amara Blue project develops.

To the maximum extent permitted by law, Amara Blue will not be responsible for indirect or consequential losses arising from the use of the website or digital content where such losses were not reasonably foreseeable.

We are not responsible for failures caused solely by services outside our reasonable control, such as internet outages, third-party payment systems, social-media platforms, or external hosting providers.

Your mandatory statutory consumer rights remain unaffected.

Personal information collected through the website is handled in accordance with the Amara Blue Privacy Policy and applicable data-protection law.
